Terms and Conditions

1. Scope

These terms apply to the use of the SmartScale platform operated by Michael Peter (SmartScale in Gründung).

2. Candidates

Use is free of charge for candidates. You decide whether and when your profile is published, which companies are blocked and which requests you accept. Information must be truthful.

3. Companies

Company access is granted exclusively through our sales team. Interview requests are free. Invoicing takes place separately.

4. Placement

4.1 When a candidate accepts a company's interview request, the business relationship between this company and this person is deemed to have been arranged and established by SmartScale.

4.2 If, within 12 months of the first touchpoint on the platform, an employment or freelance relationship is concluded between the company (including its affiliates) and the person, this counts as a placement by SmartScale – regardless of the channel through which the conversation was later continued or the contract was concluded.

4.3 For each such placement the company owes a fee of 10% of the agreed annual gross base salary (excluding variable components).

4.4 The person's contact details are not shared. Contact takes place via the platform's messaging feature; all touchpoints (profile views, requests, acceptances, messages) are logged and serve as evidence.

4.5 The company must notify SmartScale of any contract under 4.2 without delay, at the latest 14 days after signing, stating the agreed annual gross base salary.

5. AI assessments

Assessment results support decisions and do not replace the company's own evaluation. Discrimination based on protected characteristics is prohibited (Austrian Equal Treatment Act, GlBG).

6. Governing law

Austrian law applies. Place of jurisdiction is, where permitted, the operator's registered seat.
